I think they'll just use the court case and decide not to take any action - quite right, too.

FFS. why on earth would the CPS not want to prosecute in a case where they are not confident of a conviction, compared to a case where they are confident of conviction. Oh, forget minor crimes being taken to Court, murders and rapes are much more important so lets only do them.
