Much like the police trying to prosecute some one for racial hatred only for the alleged victim to say 'actually I didn;t find the remark racially offensive'. I believe race related crimes are defined by the perception of the victim aren;t they ? If someone says a crime was racially motivated then it is considered so, if they say it wasn't then it isn't.

As I said, the issue seems to be: 'why aren't arsenal bothered' as opposed to 'what is a crime?'.

I'm still intregued that you think you can be so definitive about something you don;t know anything about. I guess that's the perils of being so focused on the extremes rather than the generality. If you thought your rape example through at a more general level rather than making it as implausible as possible you might have got somewhere. I don;t think you'd believe that the matter of consent between two adults is not a matter of the perception of the victim.
